Employment Law and the Hiring Process

After briefing  the management team on employment law from Assignment 1, it is time to  apply the knowledge to internal processes. There exist many fundamental  legal concerns surrounding recruiting and the overall hiring processes  within organizations. A current review of the company’s HR policies and  procedures centered on employment law reveals some possible  opportunities to improve the overall recruitment and hiring process.  More pinpointed opportunities exist in background checks, employment  tests, and hiring and promotions. If not properly administered, these  areas may cause employment law issues within the company.

Write a six to eight (6-8) page paper in which you:

  1. Briefly  explain your overall understanding of conducting employee background  checks. Why are they done? Why are they important? Be clear with your  discussion.
  2. Identify  and discuss at least two (2) types of background checks you believe  most organizations conduct and explain how you will ensure the types you  select are properly administered in the company.
  3. List  and describe at least five (5) employee drug testing procedures you  should ensure in order to comply with state drug testing laws. How would  you ensure adherence to the procedures?
  4. Briefly  discuss your understanding of bona fide occupational qualification  (BFOQ), affirmative action preferences, and promotions. Then, identify  at least three (3) actions you would take to avoid employment law issues  with these topics. Be specific.

Your previous contributions addressing a variety of important topics outlined in all previous assignments for this course are deemed essential in supporting the business’ overall organizational structure and competitive advantage strategy. It is now time to consider developing your own HR department team to ensure they have the requisite skills and competencies necessary to perform at high levels over time. Effective and motivated HR business partners (HRBP) will be the key to translating HR and business strategy into action. The Society for Human Resource Management (SHRM) Body of Competency and Knowledge (BoCK) can be an invaluable resource to help develop and certify HR professionals. You must now explain to the management team the components of this model and how it can be leveraged to achieve operational success for the HR department. A one-hour meeting has been scheduled, and the CEO will be in attendance.

Create a 20-slide minimum PowerPoint presentation with your script or discussion or commentary in the Notes section of each slide, in which you do the following:

  1. Include cover, presentation agenda, conclusion, and reference list slides, all of which may count toward total slide count.
  2. Provide a slide with an overview on the importance of having a highly-developed staff of HR business partners. Be clear with your position.
  3. Provide 1–4 slides introducing the SHRM BoCK model and its components. Be sure to highlight each of the areas of the model. Note: It is highly recommended to insert an image of the actual SHRM BoCK model into the presentation.
  4. Include in the remaining slides the following required presentation information:
    • Provide a minimum of three to four bullet points (more if needed) of information or discussion describing the specifics on the SHRM BoCK’s “Behavioral Competencies.”
    • Provide a minimum of three to four bullet points (more if needed) of information or discussion describing the specifics on the SHRM BoCK’s “HR Expertise: Domains 1 & 2.”
    • Provide a minimum of three to four bullet points (more if needed) of information or discussion describing the specifics on the SHRM BoCK’s “HR Expertise: Domains 3 & 4.”
    • Provide a minimum of three to four bullet points (more if needed) of information or discussion describing specifics on certifying your HRBPs.
      • Note: Good PowerPoints have very few words on the slides themselves—almost all of the information you need to include should be in the Notes.
  5. Use at least four quality academic resources in this assignment. Note: You may only use the resources listed in the Course Guide and those that are specifically provided by the professor.
  6. Your assignment must follow these formatting requirements:
    • Select any one of three professional PowerPoint templates provided by the professor (required).
    • Have headings for each section with all bulleted information aligned properly and using the same font and size. Images may be used but must be professional and relevant to the topic.
    • The source or sources of all images must be credited with both citation and reference. Check with your professor for any additional instructions.
    • Include citations and references for all information received from other sources.
    • All bullet point information in the Notes sections must be descriptive and have a minimum of 3–4 full sentences.

This course requires the use of Strayer Writing Standards. For assistance and information, please refer to the Strayer Writing Standards link in the left-hand menu of your course. Check with your professor for any additional instructions.

  • Provide a brief, statistical background on the rising level of part-time versus full-time employment, including the rise of consultants versus employees.
  • Discuss the criteria a human resource professional should utilize to determine whether an organization should hire a full-time versus part-time employee, a consultant versus an employee, and what those implications would be for both an organization and an employee. Must be 300 words

COMPETITION – MARKET RESEARCH MANAGER ANALYSIS

Due Date

Week 10

Note: While representative of possible situations faced by Target & Walmart, all scenarios in this assignment are fictional.

Real Business

As you learned this week, understanding your competition and adjusting your own business accordingly is critical to a business’s success. A large discount retail store like Target competes not only with other discount retail store stores but also with those stores that offer just some of the products Target does, such as grocery stores. Keeping track of all these competitors is quite a task; that’s why large companies have a team of market researchers dedicated to managing that research.

Your Role

This week, you’ll assume the role of a Market Research Manager at Target.

WHAT IS A MARKET RESEARCH MANAGER?

Market Research Managers are responsible for creating and improving processes for gathering information on various market conditions, competitors, and consumer trends in their companies’ industries. They are typically responsible for managing a team of researchers and reporting their findings to the head of the department. Teams across the company then use these findings to help improve products, guide marketing efforts, and more.

As a Market Research Manager, part of your role is to consistently analyze Target’s position relative to its competitors and report on these findings. As part of this process, you complete a SWOT analysis for each of Target’s main competitors each quarter. The quarter is coming to a close, and your boss has asked for the latest SWOT analysis for Walmart.

  • Provide a link to the article.
  • Identify which aspects of the article will be helpful as you conduct your SWOT analysis.

Step 6: Who Will Come Out Ahead?

Step 7: Real-World Application

Conduct a SWOT analysis for your company and one of its biggest competitors using the methodology outlined in Steps 1-6.

To understand leadership within human services organizations, it is first important to recognize four frameworks that work within human services organizations. The frameworks are structural, human resource, political, and symbolic. The structural framework promotes efficient operations and goal-oriented administration. A leader under this framework may emphasize structure, strategy, and results. The human resource framework promotes human aspects, both individual and group, within an organization. A leader under this framework supports and empowers staff. The political framework emphasizes conflict and differences among organizational members. A leader under this framework attempts to build coalitions and negotiate compromise. Finally, the symbolic framework relates to organizational culture and mission. Leaders under this framework are inspirational and visionary. When organizational issues arise, one or more of these four frameworks may come into play. Leadership styles also correspond to a given framework. For this Assignment review the “Introduction to Human Services Administration″ video. Take note of and select one issue faced by the human services administrator. Consider the cause of the issue you select. Think about which framework relates to it and the leadership style that corresponds to it.
