Final Paper

Write a 5-6 page paper that demonstrates a clear understanding as well as analysis of a topic that relates to the content of this course: Law in the Managerial Environment. To receive full credit, it is important that you follow the guidelines provided in the description of the assignment (see module 01 final paper requirements for more details) and the rubric. For the paper, you must integrate information found in peer reviewed, scholarly references as defined below. Remember that this is a scholarly paper, so you will need to ensure your paper aligns with the APA 6th edition writing style. In addition, you cannot use 1st person in this (or any) scholarly paper. Also, do not use “dot com” or wiki references. You are expected to showcase the comprehension of your topic in relation to a focus area(s) of this class.

  • 5-6 pages of body
  • 8-10 peer reviewed, scholarly references. These references must be clearly cited within the body of your paper. Your textbook can be used as a reference but must be in addition to the 8-10 sources.  For the purposes of this course “Peer reviewed, scholarly references” also includes state, federal, and administrative cases, decisions, and opinions; statutes and regulations; constitutions; as well as Restatements and other legal summations of common law.

If you have ever come close to committing nursing negligence, what would your advice be for others? If not, have you ever seen someone commit negligence, and if so, what is the lesson in it? If no for each, make up a scenario to share your professional advice.

Choose scenario 1, 2, or 3 in the article. Summarize the lesson to be learned, and what you would have done to avoid the error.

Professional Platform for Ethics and Leadership

The role of the health care professional includes being a moral agent or a person whose actions affect themselves and others at a moral level. It is important to have a personal ethic or moral framework in which you ground your practice and professional relationships. The purpose of this assignment is to explore and create a foundation for leadership and ethics in your professional practice.

Write a reflection on the nature, sources, and implications of your values, beliefs, and ethical perspectives that guide your personal life and nursing practice. Please note, grading is based on the clarity and depth of your writing and the apparent effort given the assignment, not on the rightness or wrongness of your position. You are encouraged to be honest in your self-assessments and conclusions.

Each of the following points must be addressed in your essay:

  • Primary influences (childhood and adult)
  • Ethical principles that influence you personally and professionally
  • Ethical practice of professional nursing
  • Ethical leadership and professional development plan. Include both positive and negative aspects of your character that emerge when you are in a position of authority

Assignment Expectations:

Length: 600 to 2000 words total.

Structure: Include a title page and reference page in APA format. These do not count towards the minimum word count for this assignment. Your essay must include an introduction and a conclusion.

References: Use appropriate APA style in-text citations and references for all resources utilized to answer the questions. Your assignment should include at least two (2) scholarly sources

  1. In moments of frustration, some U.S. labor leaders have claimed that U.S. unions would be better off with a deregulation of labor law and a return to the “law of the jungle.” How would a return to voluntarism affect U.S. unions? Workers? Employers?
  2. What might be the pros and cons of adopting the German system of mandatory works councils in the United States?
  3. Employers commonly try to portray unions in a negative light by characterizing them as outside third-party organizations. Is this accurate if unions are composed of employees? Describe how the pluralist industrial relations school of thought sees value in having a union as both an outsider and an insider. In what direction(s) should U.S. labor unions go to serve these roles in the 21st century?
  4. What is a corporation’s social responsibility? Are there corporate labor relations practices that should be unacceptable? If so, how should these standards be enforced?

Position and Compensation Classifications

 

Prior to beginning work on this discussion forum, review this week’s readings and Weekly Lecture.

Identifying the proper classification for each position is an important responsibility of the HR department. Depending on the size of the organization, there are various ways that a classification is decided and put into practice. Larger organizations require specific levels of approval of the classification before implementation, whereas with smaller organizations, the determination is often made by the HR director.

For this discussion, take the role of the HR director in a small organization. The organization is adding two new positions to the workforce, and it is your responsibility to determine the classification and compensation categories for each position. Carefully determine the role of each position and the responsibilities of the position within the organization. Determine the logical classifications for each position. Define and defend each category selected for the position and your reasoning for selecting the options. Support your decisions with resources that defend your choices.

Position 1:

This position is responsible for customer service and responding to the complaints of the consumer. The employee will work a 6-hour day, three days a week, with a rotating shift. This position will report to a supervisor and will have no direct reports.

Position 2:

This position is responsible for all accounts payable and accounts receivable. The employee enters all information into a data system and develops monthly reports for the CFO of the organization. This position has four direct reports that perform a variety of accounting duties. This position works an eight-plus-hour-a-day schedule, five-plus days a week, depending on need.
