EEOC Complaint Process Paper

Assignment Content

  1. Search for the following key terms: discrimination complaint process, litigation process, mediation process, and dispute resolution.

Scenario: John identifies as a Hispanic employee in a private sector organization. He is regularly called an “idiot” by his supervisor. The supervisor has hardly ever called non-Hispanic employees derogatory names. Finally, the supervisor starts calling John an inflammatory name that is known to be derogatory to Hispanics. John now finds his work environment intolerable, though his supervisor has no intention to demote or fire John for any reason. John, however, wants to file a discrimination complaint against his employer. He went to his HR department first, but was dissatisfied with their lack of help.

Prepare a 700- to 1,050-word paper written in the third person voice in which you analyze and explain the discrimination complaint and civil litigation process as it would potentially apply to John and his employer.

    • What are the elements of a hostile work environment harassment claim?
    • Can John potentially satisfy the elements of a hostile work environment harassment claim?
    • Does his employer have any defense for the supervisor’s conduct?
    • Identify whether John can make a prima facie case of a hostile work environment by identifying the elements required to bring a cause of action for discrimination.

Explain how the complaint process begins with the Equal Employment Opportunity Commission (EEOC) and proceeds with a right-to-sue letter through the civil litigation process from the state level up to the U. S. Supreme Court.

Include a discussion on Title VII of the Civil Rights Act of 1964 and other relevant aspects addressing discrimination complaints and disputes in the workplace.

Format your paper consistent with APA guidelines, including using headings to appropriately signal topics to keep your document organized.

Use a minimum of three different in-text citation sources within your paper, and properly identify them in your References page. Any laws and legal cases used in the body of your paper must also be included in the References page.

Labor Relations

Question A

Many major strikes used military personnel during the struggle. Do you think this was fair? Was it ever neutral? Do you think it was ethical? Explain why or why not.

Question B

In May 1884, May 1, 1886 was established as the effective date for the eight-hour day. This is the modern origin of May Day. Previous to this class, were you aware of the origin of May Day? What do you think would happen if you initiated a 7-hour work day, or four day work week?

Answer both questions with credible references.

5 pg APA ethic interview

DIRECTIONS:

You will write an APA 7th Edition paper, 5-7 double-spaced pages in length, on someone of your choosing who is currently in an executive position or in a leadership role. They should be considered a C-Level (CEO, CIO, CFO, etc.) executive or in a prominent leadership position.  At a minimum this person needs to be responsible for a significant function in an organization and have supervisory responsibility over others.  The interview may be conducted on the phone, virtually, or in person (your methodology or mode of conducting the interview, must be documented in your paper).  This paper must include a minimum of five (5) peer-reviewed, refereed journal articles pertaining to your subject’s ethics. As a guideline, your paper should include:

  1. DESCRIBE: A description of the subject’s ethical beliefs and practices. In two pages (approximately) you should address the following: What challenges have they encountered in the workplace that have shaped their views on ethics? How have they addressed those challenges (their ethical reasoning)?
  2. ANALYZE: An analysis of the subject’s ethics.  How did he or she evolve their view of ethics?

What ethical theories are expressed or implied in his or her discussion of ethics.  Examine whether there were inconsistencies, deficiencies, inadequacies in his or her ethical theory. If there were no shortcomings, account for the strength of the subject’s ethical position. What motivated the leaders to act appropriately or inappropriately, in your opinion? This should be approximately two-three pages.

  1. SYNTHESIZE and EVALUATE: Do you agree with your subject’s approach to ethics? If not, why not, and if so, then why?  What did you learn from this interview and your research?  About two pages are adequate for this portion.

You are to summarize and analyze the content of the interview, not provide a verbatim transcript of the interview. This is due on Sunday of Week Six, and is worth 300 points. The grading rubric for this paper is provided in Course Information in Blackboard.

Discussion

First Post—Module 3

A common form of training is cooperative training. There are two widely used cooperative training methods: internships and apprentice training. In both forms of training, there is a combination of classroom training (formal education) and on-the-job training (experience) that can be used for career development. Based on your experiences, discuss the added value of cooperative training. How do we as HRM professionals objectively determine the “value” of cooperative training? Then, discuss the problems of cooperative training that should be taken into consideration by human resource professionals. Finally, make a recommendation as to how cooperative training can be assessed and used for succession planning.

Support your post with additional information from at least two reputable sources (library and/or web-based). Cite your sources. Bring in your own personal experiences, if applicable.

Question 2

Please answer the questions below. Use question and answer (Q&A) format for your response; in other words, include the original question along with your answer in the reply. Within your post support your responses with information from at least two reputable sources (library and/or web-based) and provide the full citation at the end. Use APA format for your references. Include your own personal experiences, if applicable.

  1. What position/positions in your organization are accountable for workplace relations in your organization? What impact do they have? What programs are in place to impact relations at work? Provide specific examples.
  2. If you were an HR manager in a private-sector organization, what key programs would you implement to improve employee-employer relations? Why?
  3. How would you determine the added value of your programs?

INTRODUCTION, BODY, AND CONCLUSION

Beau Street Runners, Ltd.

Beau Street Runners, Ltd (BSR) is a courier service with headquarter on Beau Street in a first-tier suburb of a megalopolis severing four co-joined big cities with many different ethiccommunities and massive transportation grids. BSR provides cabs, bicycles, vans and armored trucks for moving important packages between businesses in the various cities and surrounding suburbs (approx. 125 miles along a waterfront and 100 miles wide edging into foothills) in a “northern” climate with significant weather variations.

Obviously, security is an issue for BSR. Currently, they provide training programs on personal security and on the BSR’s standards for securing packages. Their standards are being met in all areas except customer service. Since customer service is about relationship building between customer and the runner, it may be challenging to build a learning solution that satisfies the need. However, your contact at BSR believes that their Runners are their ultimate image. Therefore, this customer problem needs to be fixed and they will do anything at all to fix it.

You have been hired to build a low-tech training solution for these associates. Based on the information below, what are the key cognitive issues, and memory/attention factors that you will consider in your designs? Based on that analysis of the essential learning needs, what learning theories and technologies would be most likely to meet the need? Explain your reasoning and support your opinions in a 2-3 page paper using APA format.
—————————————————————————————————-
BSR Runners:

· Age: 18-28 (average age 31)

· Gender: 68% are male; 32% are female

· Type of work:

· 35% are bicyclists specializing in very small packages of less than $500 value

· 15% are cab drivers

· 17.5% are van drivers

· 18.5% are truck drivers

· 13% are special-agents working only with highly insured packages ($100K plus) and special projects that may require days or weeks (e.g., moving museum pieces)

· 80% of the bicyclists indicate that this is first full-time job

· 25% of all employees indicate that this is a part-time second job

· 79% indicate that they have earned a Brown Belt or higher in at least one martial art while the rest indicate that they attend martial arts training

· Special agents earn more than $100k a year and the other runners are unaware that such agents exist

· When surveyed about the work bicyclists Runners indicated that:

· They enjoy the challenges of navigating the multi-city transportation grid but also find it stressful

· Carry a PDA with GPS, phone, internet and carry technology for tracking and managing packages and signatures from those accepting packages

· They are only paid when they work, so they have no “down time” in which to take training

· They enjoy physical aspects of the job and the high-alert energy they must maintain to stay secure and keep their packages secure.

· Extreme weather was their greatest hazard (after traffic) with winter days reaching into the -10 degree range regularly and summer days often near or over 100 degrees.

· A tally of the last 100 customer service complaints show that:

· 5:8 customers indicated that their courier was “curt” and “uncooperative”

· 3:10 customers indicated that their courier was unable to explain why their package arrived late

· 7:20 indicated that pick-up courier “scared them”, when asked for further information they said the following about individuals in various roles:

· The bicyclist courier’s looked weird and scary – like a cross between street people and a terrorist.

· The cab driver was foreign and didn’t seem to understand me

· The van driver or armored truck drivers and assistants had shifty eyes… always checking around them, I felt like they were waiting for someone to pop out from behind me and attach them.

Your paper should reflect scholarly writing and current APA standards. Please include citations to support your ideas.
