This assignment gives students the opportunity to review and dissect a legal decision—to identify its different elements, the types of laws involved, and the basis for the decision. For this assignment, be sure to carefully read Chapter 1 from the textbook as well as the court case below, Simkins v. Moses H. Cone Memorial Hospital. You may need to do additional research for the final question to support your analysis.

Case Assignment

After carefully reviewing the required readings, answer the following questions. Copy the questions directly from the assignment and answer them each separately.

  1. Identify and explain the four sources of law in the United States and give an example of each.
  2. What is the citation for the Simkins case? Label each part of the citation.
  3. Define what majority and dissenting opinions are. Identify who drafted each for this case.
  4. At what level of the judiciary was this case decided?
  5. Identify and explain the legal statute that was examined in this case and its relevance.
  6. Constitutional law was also a factor in the decision. Identify and discuss the amendments that were addressed and their importance to this case.
  7. The reach of this case was limited. Why is that?
  8. Explain the relationship of ethics to this decision. Be sure to identify relevant ethical principles.
  9. What is the relevance for health administrators in studying a case such as Simkins? There is no one answer for this, but be sure to provide your critical analysis and support it with reliable sources.

For this assignment, imagine you are an expatriate manager for a subsidiary of a major company headquartered in the United States. You are preparing a PowerPoint presentation to brief the CEO on your plan to address the safety issues specific to the country (of your choice) where you are working as the expatriate manager.

In your introduction, discuss four concerns in the workplace: benefits, safety, health, and global security issues. List one issue for each concern listed.

Next, prepare a solution for each of the four concerns. Discuss how your solutions address the issues within the workplace. Discuss what would be the responsibility of the global leadership team.

Discuss the various components of new employee onboarding, including new hire orientation. Which part do you believe to be most important and why? What is the human resource manager’s role in the employee onboarding process? What is the manager’s role?

Discussion Two: Application

  • Recognize that ethics are based on one’s personal morals, and therefore an ethical leader is not always a good leader because his or her morals may not align to the most effective leadership      decisions.
  • Ethics and leadership are more about the leader’s set of moral beliefs being a priority. 

Part 2

  • The goal of serving and leading is to understand that by serving the followers, you build trust and loyalty, and they will in turn follow you. You can serve and lead because by serving and listening to your followers, you understand their needs and are able to build them and develop them. When you      develop them, you make them better leaders, so you are serving their needs  to become better.
  • Although responses will vary, the servant leader will generally move in and out of these characteristics. They will use a combination of  these characteristics at different times. These      characteristics show the overall heart and focus of the servant leader. The characteristics of a servant leader are moral behaviors.
